The University is required to respond to all reports of sexual misconduct, civil rights discrimination, and workplace violence in the most appropriate manner. Responding to these concerns does not indicate that there has been a violation of UW policy.

After receiving a report, the University will begin an initial assessment, which normally will start within 72 hours of receipt of an incident report. Typically, this will include the following actions:

  • The Title IX Team reaches out to the person impacted to offer supportive measures and to ensure they are aware of the right to have an Advisor.

  • The Title IX Team seeks to determine if the person impacted wishes to make a formal complaint, and will assist them to do so, if desired.

    • If they do not wish to do so, the Title IX Team determines whether to initiate a complaint because a violence risk assessment indicates a compelling threat to health and/or safety.

  • The Title IX Team works with the Complainant to determine whether they prefer a supportive and remedial response, an informal resolution option, or a formal investigation and grievance process (Process A).

    • If a supportive and remedial response is preferred, the Title IX Team works with the Complainant to identify their wishes, assess the request, and facilitate implementation accordingly. Process A is not initiated, though the Complainant can elect to initiate it later, if desired.

    • If an informal resolution option is preferred, the Title IX Coordinator assesses whether the complaint is suitable for informal resolution, which informal mechanism may serve the situation best or is available, and may seek to determine if the Respondent is also willing to engage in informal resolution.

    • If a Formal Grievance Process (Process A) is preferred, the Title IX Coordinator determines if the misconduct alleged falls within the scope of Title IX:

    • If it does, the Title IX Coordinator will initiate the formal investigation and grievance process, which can address an individual incident, a pattern of alleged misconduct, and/or a culture/climate issue.

      • If it does, the Title IX Coordinator will initiate the formal investigation and grievance process, which can address an individual incident, a pattern of alleged misconduct, and/or a culture/climate issue.

      • If it does not, the Title IX Coordinator will "dismiss" the complaint within Process A and refer the matter to Process B. Please note that dismissing a complaint under Title IX is just procedural and does not limit the University's authority to address a complaint with an appropriate process and remedies.

Both Process A and B involve meetings with the Complainant and Respondent to:

  • Review the written incident report;

  • Collect or request all relevant evidence and documents;

  • Review the rights and options with respect to the incident reported;

  • Review the relevant interim protective measures;

  • Review what informal resolution options may be available to the parties.

The review or investigation may also include:

  • Meetings with witness(es) who have direct knowledge of events.

  • Review of all relevant documentation.

  • Follow-up meeting(s) or contact(s) with the person filing the incident report and the accused to ascertain additional information, to clarify information, and to update on the status of the investigation process.

The person conducting the investigation shall prepare a written report, including the summary of findings and outcomes. They may use University resources, including peers or colleagues trained in Title IX proceedings, to assist in the preparation of the written report.

A copy of the report will be provided to the Complainant and Respondent. Witnesses will not receive the written report, but may review any sections which refer to them.  Depending on the process used and the information collected, a hearing may be held to determine the final outcome.  

At the conclusion of the investigation, the University will retain all records and notes of the investigation.

UW will make a good faith effort to complete the resolution process within a sixty-to-ninety (60-90) business day time period, including appeal, which can be extended as necessary for appropriate cause by the Title IX Coordinator, who will provide notice and rationale for any extensions or delays to the parties as appropriate, as well as an estimate of how much additional time will be needed to complete the process.


Title IX Coordinator

Victims of sexual misconduct may make a report directly with the Title IX Coordinator. The Title IX Coordinator is available to offer ongoing support to victims of sexual assault in understanding UW’s investigative and/or disciplinary processes or the criminal process as the victim chooses.

The Title IX Coordinator has the duty to address sexual violence and remedy the effects on the victim and the University community. The Coordinator will make every effort to maintain confidentiality, but may be required to investigate the incident.

Mandatory Reporters

Many employees (faculty members, administrators, residence assistants and directors, coaches, advisors) are able to offer emotional support to victims and help direct them to appropriate resources. Mandatory reporters, upon receiving notice of sexual misconduct, are required by law to notify the Title IX Coordinator about the details of sexual misconduct.  At UW, ALL EMPLOYEES are considered mandatory reporters except those who have been designated confidential employees (victim advocates, health care providers, mental health counselors, and clergy acting in their professional/confidential role). 

 

Anonymous Reports

There are anonymous ways to make a report of sexual assault, even to law enforcement. The following are ways to report do not require your name or information to make a report, though you may choose to provide it:

Law Enforcement

The University of Wyoming encourages reporting possible crimes to law enforcement. Even when a report has been made to law enforcement, employees are required to make a report to the Title IX Coordinator; all others are encouraged to report to UW as well. Please be advised that criminal processes are separate from and independent of the University of Wyoming.

Confidential Employees

UW has employees who are available to offer victims of sexual assault support and guidance in a completely confidential environment. Individuals may choose this option if they want to talk about the incident but do not want any further action to be taken. Confidential employees can provide individuals with both immediate and long-term help. They will listen, and help access additional assistance and explain options for obtaining additional support.

In addition to the confidential resources provided by UW, individuals may speak with off-campus crisis counselors, domestic violence resources, private agencies, and off-campus members of the clergy, each of whom will maintain confidentiality, except in extreme cases that involve a minor or immediate danger.
