Stalking

What is Stalking?

Wyoming has a law prohibiting stalking. In Wyoming, a person commits the crime of stalking if, with intent to harass another person, the person engages in a course of conduct that is reasonably likely to harass that person, including but not limited to any combination of the following:

  • Communicating, anonymously or otherwise, or causing a communication with another person by verbal, electronic, mechanical, telegraphic, telephonic or written means in a manner that harasses;
  • Following a person, other than within the residence of the defendant;
  • Placing a person under surveillance by remaining present outside his or her school, place of employment, vehicle, other place occupied by the person, or residence other than the residence of the defendant; or
  • Otherwise engaging in a course of conduct that harasses another person.

Stalking Penalties
In Wyoming, stalking is a misdemeanor and if a person is convicted of stalking, can be imprisoned for up to 6 months, or fined up to $750, or both.

Wyoming also has a felony stalking law, which is punished by up to 10 years in prison:

  • if the acts of stalking happened within 5 years of another stalking conviction;
  • if the stalker caused serious physical injury in conjunction with the stalking;
  • if the person committed the stalking in violation of any condition of probation, parole, or bail;
  • or if the person committed the offense of stalking that was in violation of a temporary or permanent order of protection.
