Whether it's in industry, real estate practice or simply in
daily life, the law of real property intimately affects our
decisions. This course is designed to illuminate this vital,
but often overlooked, aspect of business's legal environment.
In addition, it is a part of the real estate certificate program
offered through the College of Business.
Course Objectives
To provide a foundation for understanding the intricate web
of law involved in land transactions, the course opens with
an overview of the basic principles of law which shape and
define real estate. After a brief review of basic legal concepts,
the course addresses basic questions. What is real property?
What are the rights of owners? What are the rights of others?
Next, in some depth, the course examines the process followed
in transactions involving real property. How is land sold? How
is land bought? How are purchasers secure in their purchase
--how about lenders?--how about tenants?
The final portion of the course is devoted to the often
frustrating, but always important, limitations on and
requirements of land ownership in a crowded and
complex society. Am I secure in my own property?
How does the state control and influence my decisions
regarding my property? Are there limitations regarding
the environment?
In this course, students should develop an understanding
of the listed topics.
