Lawsuits, Subpoenas, and Government Investigations

Contact the Office of General Counsel immediately at (307) 766-4997.  A subpoena is a judicial order requiring a person to appear in court or for a deposition and to give testimony with respect to a dispute before the court or an administrative proceeding.  A subpoena duces tecum is a judicial order requiring a person to bring records or documents in his/her possession that pertain to the matter in dispute to the court or to be produced at a specified location. A summons is notice of a lawsuit often accompanied by a complaint.

A subpoena or summons must meet several specific requirements before it is legally enforceable. If an employee receives a subpoena to provide documents, an attorney in the Office of General Counsel will review the documents to determine whether they are responsive to the subpoena and whether any of the information is confidential.  Faculty and staff should never respond directly to the issuing/serving party of the subpoena or summons or provide documents in response to a subpoena without first giving the information to the Office of General Counsel to review.

 

 
Contact the Office of General Counsel immediately at (307) 766-4997.  By law, the university must respond to lawsuits within a specified time period after you are served.  It is essential that you notify an attorney as soon as you are served so the Office of General Counsel can timely review the matter and respond appropriately.
Contact the Office of the General Counsel immediately at (307) 766-4997.  Your response to an interview request by a government investigator, an informal request for documents or a search warrant should be coordinated and supervised by the Office of General Counsel.  If a government investigator asks you to grant them an interview you are free to do so, but you are under no legal obligation to grant an interview.
