Bike Locker Rental Contract Terms and Conditions

“LESSOR IS UW VENDING SERVICES” “LESSEE IS STUDENT”
 
1. No part of the rental fee is refundable. The deposit will be refunded to Lessee upon the return of the bike locker key less deductions for missing accessories and/or damage in excess of ordinary wear and tear.
2. The bike locker key must be returned to Lessors’s office by the identified Contract Expiration date and during posted office hours, otherwise the deposit is forfeited.
3. Lessee will bear the burden of any loss or damage.
4. Lessor will fix the bike locker if it needs repair; however, if the repair is necessitated by Lessee’s action or inaction, Lessee will pay for repair costs.
5. Lessee agrees to receive their Deposit through a credit on their WyoOne card or a credit to their UW student account.
6. Lessee agrees to defend, indemnify and hold harmless the Lessor and its public employees from any and all claims arising from the services performed under this Contract or related to this Contract.
7. Lessor and Lessee agree that (i) the laws of Wyoming shall govern this Contract; (ii) any questions arising hereunder shall be construed according to such laws; and (iii) this Contract has been negotiated and executed in the State of Wyoming and is enforceable in the courts of Wyoming.
8. Lessor does not waive its sovereign immunity or its governmental immunity by entering into this Contract and fully retains all immunities and defenses provided by law with regard to any action based on this Contract. Any actions or claims against Lessor under this Contract must be in accordance with and are controlled by the Wyoming Governmental Claims Act, W.S. 1-39-101 et seq. (1977) as amended.
