Novogrodsky Publishes in Harvard International Law Journal

UW College of Law Professor Noah B. Novogrodsky is co-author with Gregory H. Fox of an article published in the winter 2023 issue of The Harvard International Law Journal. In the article, “Of Looting, Land, and Loss: The New International Law of Takings,” Novogrodsky and Fox argue the U.S. Supreme Court erred in Federal Republic of Germany v. Philipp (2021), as international law has traditionally protected aliens against unlawful expropriations by host states. They explore ideas of “property constitutive of personhood” for aliens and citizens and different forms of restitution and remedy. They present a “human-centered conception of property” they say has been missing from international law debates.
