By use of AHC websites and content, including AHC digital collections, and any data contained therein, the user agrees that use shall conform to all applicable laws and regulations and user shall not violate the rights of any third parties.

Both the laws of the State of Wyoming, U.S.A.—Title 6 of the Wyoming Statutes, Crimes and Offenses, Chapter 3, Article 5, Computer Crimes (Wyo. Stat. ' 6-3-501 et seq.)—and the laws of the United States—Title 17, United States Code, Copyright—govern liability for misuse of the contents of this site.

Use of This Website

The copyright law of the United States (Title 17, United States Code) governs the making of reproductions of copyrighted material. Under certain conditions specified in the law, libraries and archives are authorized to furnish a reproduction to users. One of these specified conditions is that the reproduction is not to be "used for any purpose other than private study, scholarship, or research." If a user later uses a reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement. The American Heritage Center reserves the right to refuse to accept a copying order if, in its judgment, fulfillment of the order would involve violation of copyright laws.

Material Created by the AHC includes such things as catalog records, digital image metadata, finding aids, exhibit text, curriculum units, and most text on most of the pages on this site; more generally, it includes all material on AHC websites with the exception of facsimiles and other copies of collection material, copyrights to which may be a) extinguished, by having passed into the public domain; b) owned by the creator of the original or his/her/its heirs or assigns; c) owned by the University of Wyoming’s American Heritage Center. Material created by the AHC is © University of Wyoming, 1996-2010.

The University of Wyoming and its agencies are and shall remain the sole and exclusive owner of all rights, title and interest in and to American Heritage Center-generated content, including ownership of any copyright pertaining thereto, except as specifically noted.

Copyright and Archival Collections

Material Created By Others includes all facsimiles and other digital copies of collection material in the American Heritage Center’s collections.

The AHC makes digital versions of collections accessible for educational and research purposes in the following situations:

They are in the public domain
Rights are owned by the AHC
The AHC has permission to make them accessible
There is a fair use basis
There are no known restrictions on use

When the original material was donated to the American Heritage Center, such copyrights in the donated material owned by the donor may have been transferred explicitly to the American Heritage Center. More often, however, such copyrights in the donated material owned by the donor remain in the possession of the donor or his/her/its heirs or assigns. The American Heritage Center disclaims responsibility for determining the copyright status of original collection material and thus of digital reproductions on this site; such responsibility is the user’s alone. However, the Center does assert its rights as owner of the physical originals, and as such must grant separate permission for commercial uses of digital reproductions of such originals. But, again, additional permissions may be required from the holder of copyrights in the original material.

Digitized collection materials are accessible for educational and personal research purposes. If you are the copyright owner of material found on AHC websites and believe the AHC has used your work beyond fair use and without permission, we want to hear from you. If there is a problem, we will remove the material from public view while we look into it. Please contact us via this online form.

If a user wishes to use for commercial purposes any of the digital reproductions of original collection materials in any physical or digital form, including display or webpage use, the user must obtain prior written permission from the American Heritage Center as the owner of the original and from the copyright holder. Please consult the AHC's schedule of Commercial Use Fees or contact the Reference Department, regarding commercial use or to purchase photographic prints or scans. The credit line must read "From the Collections of American Heritage Center, University of Wyoming.” For Web site use the statement must read "From the Collections of American Heritage Center, University of Wyoming, Copy and Reuse Restrictions Apply" and be placed near the image.

The American Heritage Center has an interest in protecting the integrity of the original. The Center will not allow certain types of alterations in the use of copies of originals it owns. For example, for images the Center does allow adjustments to contrast and sharpness, minor adjustments of color, cropping the edges, or selection of a coherent portion. An explanatory statement-e.g., “Detail from….”--must be added describing any changes.
