Limitations on Participation in the Research Scholar or Professor Categories

In addition to the general eligibility rules, participation in the Professor or Research Scholar categories is subject to the following additional conditions unique to participation in those categories:

 

The prospective exchange visitor cannot be a candidate for a tenure track position

This requirement is interpreted to mean that a J-1 Professor or Research Scholar cannot hold tenure or be placed in a position on a tenure track. A person can, however, occupy a position temporarily even if the position is normally tenured or tenure-track. For example, an individual may occupy in a visiting capacity a position that is normally tenured or tenure track, such as serving as a visiting professor in a position held by a tenured professor who is on sabbatical. This must be clearly documented in their UW/HR record.

 

Prior participation in any J category may subject the prospective exchange visitor to the “12-month bar”

A prospective Exchange Visitor is not eligible to begin an exchange program as a Professor or Research Scholar based on a DS-2019 issued to begin a new program at UW if he or she was physically present in any J status (including J-2 status) for all or part of the twelve month period immediately preceding the intended UW appointment start date. This also applies whether the prospective Exchange Visitor held the J-1 or was a J-2 dependent of a previous Professor or Research Scholar. The 12-month bar is not applicable to those who/whose:

• Will transfer to UW from a current J-1 program within the US;
• Previous physical presence in J status was less than six months as documented on the previous Form DS-2019, or in the SEVIS immigration system;
• Was present in the US in the Short-Term Scholar category.

 

Prior participation in the Professor or Research Scholar category may subject the prospective exchange visitor to the “24-month bar on repeat participation”

A prospective Exchange Visitor is not eligible to begin an exchange program as a Professor or Research Scholar at UW if they completed a prior program as a Professor or Research Scholar within the 24-month period prior to the intended UW appointment start date as documented on the Form DS-2019 or in the SEVIS immigration system. This applies whether the visitor completed a full five-year appointment or completed part of an appointment and has completed their objectives and departed the US, within the 24 months prior. This also applies whether the prospective Exchange Visitor held the J-1 or was a J-2 dependent of a previous Professor or Research Scholar.
