A subpoena is a judicial order requiring a person to appear in court or for a deposition and to give testimony with respect to a dispute before the court or an administrative proceeding. A subpoena duces tecum is a judicial order requiring a person to bring records or documents in his/her possession that pertain to the matter in dispute to the court or to be produced at a specified location. A summons is notice of a lawsuit often accompanied by a complaint.
A subpoena or summons must meet several specific requirements before it is legally enforceable. If an employee receives a subpoena to provide documents, an attorney in the Office of General Counsel will review the documents to determine whether they are responsive to the subpoena and whether any of the information is confidential. Faculty and staff should never respond directly to the issuing/serving party of the subpoena or summons or provide documents in response to a subpoena without first giving the information to the Office of General Counsel to review.
